Privacy policy and data processing

At Creatius estudio digital we take care of your data. Here we explain, in plain language, what data we collect, why we use it and how you can exercise your rights.

Last updated: October 8, 2026

01Data controller

The controller of your personal data is Creatius Estudio Digital, identified with NIT 1143862759-1, operating under the brand Creatius estudio digital.

  • Address: Avenida Sachamate 26A-60, Jamundí, Valle del Cauca, Colombia
  • Email: hola@creatiusdigital.com
  • Phone / WhatsApp: +57 318 540 7973
  • Website: creatiusdigital.com

02Applicable law

We process your data in accordance with Colombia’s Statutory Law 1581 of 2012 and Decree 1377 of 2013 (compiled in Decree 1074 of 2015). If you live in the European Union, we also apply Regulation (EU) 2016/679 (GDPR) and, in Spain, Organic Law 3/2018 (LOPDGDD).

03What data we collect

We only ask for the data we need to help you:

  • Contact form: name, company or brand, email, phone or WhatsApp, country, services you’re interested in, preferred contact method and your message.
  • Video call booking: name, email, WhatsApp (optional), the service you’re interested in, the date and time you choose and your time zone.
  • WhatsApp and email: any data you share when you write to us.
  • Browsing data: the technical information generated when you visit the site, explained in our cookie policy.

We do not ask for sensitive data or data from minors.

04How we use your data

  • To answer your messages and information requests.
  • To prepare and send you quotes and proposals.
  • To schedule, confirm and hold video calls (we send you the invitation by email).
  • To provide the services you hire and manage our business relationship, including billing.
  • To send you Creatius news or content, only if you authorize it; you can withdraw your consent at any time.

05Authorization and legal basis

By submitting the form or booking a video call, and ticking the acceptance box, you give us your prior, express and informed authorization to process your data for the purposes above (Law 1581 of 2012).

For people in the European Union, the legal bases are: your consent (Art. 6.1.a GDPR), taking pre-contractual steps or performing a contract when you request a quote or hire a service (Art. 6.1.b), and complying with legal obligations, such as tax obligations (Art. 6.1.c).

06How long we keep your data

We keep your data for as long as needed to handle your request. If you hire our services, we keep it for the duration of our business relationship and afterwards for the periods required by law (for example, accounting and tax requirements). If we don’t end up working together, we delete it when it’s no longer needed or when you ask us to.

07Who we share your data with

We do not sell or transfer your data. It is only shared, as data processors, with the providers we need to operate:

  • Google (Google Workspace): email, calendar and Google Meet video calls.
  • Meta (WhatsApp): messaging, when you write to us on WhatsApp.
  • Hostinger: website hosting.
  • The website’s forms plugin, which stores the messages you send us.

Some of these providers store information on servers outside Colombia and the European Union (for example, in the United States). In those cases, the international transfer is made with the safeguards required by law, such as the European Commission’s standard contractual clauses or the EU–U.S. Data Privacy Framework.

08Your rights

If you are in Colombia (Law 1581 of 2012, Art. 8), you can: access, update and correct your data; request proof of the authorization you gave us; find out how we use it; revoke your authorization or ask us to delete it; access it free of charge; and file complaints with the Superintendence of Industry and Commerce (SIC).

If you are in the European Union (GDPR), you can exercise your rights of access, rectification, erasure, objection, restriction of processing and data portability, withdraw your consent at any time and lodge a complaint with the supervisory authority; in Spain, the Spanish Data Protection Agency (AEPD).

09How to exercise your rights

Write to us at hola@creatiusdigital.com with the subject line "Personal data", tell us which right you want to exercise and attach a document that allows us to confirm your identity.

  • Inquiries (Colombia): we reply within 10 business days, extendable by 5 more if necessary.
  • Claims (Colombia): we reply within 15 business days, extendable by 8 more.
  • GDPR requests: we reply within one month, extendable in the cases provided for by law.

10Security

We apply reasonable technical and organizational measures to protect your data: encrypted connections (HTTPS), password-protected access to our tools and access limited to the team members who need it.
